Terms and Conditions of Sale
These General Terms and Conditions of Sale govern all relations between the sole proprietorship Cédric Caprais – Fleur du Népal, operator of the website https://www.fleurdunepal.com, whose registered office is located at 15 rue Robert Surcouf, 33510 Andernos-les-Bains, France, and its customers.
Before placing any order, the customer acknowledges having read these General Terms and Conditions of Sale and accepting them without reservation when confirming the order.
• Specific Conditions of Sale
When placing an order, the customer acknowledges having been informed of the essential characteristics of the products offered, including their description, price, composition, dimensions, weight, colours, availability, delivery charges and any restrictions applicable to certain products.
Confirmation of the order constitutes full and unconditional acceptance of these General Terms and Conditions of Sale.
• Product Pages
Photographs illustrating the products are not contractually binding. Despite the care taken in producing them, slight differences in colour may occur depending on the screen used.
Product descriptions are prepared with the greatest care based on the information available to us.
• Orders
Before confirmation, every order is subject to a summary showing all products selected by the customer.
Payment for the order may be made using the payment methods offered on the online store, including:
• Credit or debit card (CB, Visa, Mastercard, American Express)

• PayPal

• Google Pay
• Klarna (subject to eligibility)

Fleur du Népal confirms acceptance of the order by email.
The sale is deemed concluded when this confirmation is sent.
Fleur du Népal reserves the right to refuse or cancel any order, particularly in the event of a supply problem, obvious error, suspected fraud, illegible document, dispute with the customer or any other legitimate reason.
Any new order may be refused until all outstanding amounts relating to previous orders have been paid in full.
• Delivery
Orders are shipped by Colissimo, Chronopost or any other carrier selected by Fleur du Népal.
Delivery is made to the address provided by the customer when placing the order. This address must be complete and accurate.
Delivery times indicated on the website are provided for information purposes only. They may vary depending on the destination, carrier, customs formalities or any event beyond our control.
Fleur du Népal cannot be held liable for delivery delays resulting from force majeure or external circumstances such as strikes, natural disasters, fires, technical failures, disruption to transport networks or any other event preventing the proper fulfilment of the order.
The products remain under the responsibility of Fleur du Népal until they are physically delivered to the customer or to a third party designated by the customer, in accordance with the provisions of the French Consumer Code.
The customer is advised to check the condition of the parcel upon receipt and to report any irregularity to both the carrier and Fleur du Népal as soon as possible.
If a product is out of stock or temporarily unavailable, Fleur du Népal may offer the customer a refund, an exchange or delayed shipment, subject to the customer's agreement.
An order containing several items may, when necessary, be shipped in several parcels at no additional cost to the customer.
• Prices
Prices displayed on the website are expressed in euros (€) and include all applicable taxes (VAT included), excluding delivery charges.
Fleur du Népal reserves the right to change its prices at any time. However, products are invoiced at the prices in force when the customer confirms the order.
Any applicable delivery charges are displayed before final confirmation of the order.
For deliveries outside the European Union, customs duties, import taxes or other charges may be imposed by the authorities of the destination country. If such charges apply, they are exclusively the responsibility of the recipient and are not paid or covered by Fleur du Népal.
Any such charges are not included in the price of the products or in the delivery charges invoiced when the order is placed. Fleur du Népal cannot determine their amount in advance, as this depends on the regulations applicable in the destination country.
• Right of Withdrawal
In accordance with the provisions of the French Consumer Code, consumer customers have a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to provide a reason and without incurring any costs other than those provided for by law.
As an additional commercial policy, Fleur du Népal accepts returns up to thirty (30) days after receipt of the order, subject to compliance with the conditions set out below.
The right of withdrawal cannot be exercised for products excluded under applicable regulations, particularly products personalised at the customer's request.
• Returns
Returned items must be new, unworn, unwashed, free from odours and undamaged, and must be returned in their original packaging or gift pouch, together with any accessories or instructions supplied.
Any returned product that is incomplete, used, damaged, soiled or unsuitable for resale may be refused for refund or may be subject to a reduction in the refund in accordance with applicable law.
Return shipping costs are borne by the customer, except in the event of an error in preparing the order on our part, a defective product or where otherwise required by law.
Exchanges are possible subject to product availability.

The customer is advised to include the order number and indicate whether an exchange or refund is requested in order to facilitate processing.
• Refunds
Refunds are made using the same payment method as that used for the order, unless the customer expressly agrees to another method of reimbursement.
Refunds are made within a maximum period of fourteen (14) days from receipt of the returned products or proof that they have been sent back, in accordance with the provisions of the French Consumer Code.
Where the legal conditions are met, the refund includes the price of the returned products and the delivery charges corresponding to the standard delivery method offered when the order was placed.
No refund may be made before the returned products have been received and inspected.
• Legal Guarantees
All products sold by Fleur du Népal are covered by the legal guarantees provided for in Articles L.217-3 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code concerning latent defects.
The consumer has a period of two years from delivery of the goods to take action under the legal guarantee of conformity.
Under the legal guarantee of conformity, the consumer may choose between repair and replacement of the goods, subject to the conditions provided for by law.
The consumer may also invoke the guarantee against latent defects in accordance with the provisions of the French Civil Code.
• Liability
Fleur du Népal cannot be held liable for non-performance or improper performance of the contract where this is attributable to the customer, a third party to the contract or an event of force majeure within the meaning of French law and case law.
In particular, Fleur du Népal cannot be held liable for interruptions to Internet networks, malfunctions of payment services, delays attributable to the carrier or customs authorities, or any event beyond its control.
Product photographs, illustrations and descriptions are presented with the greatest care. Slight differences in colour, dimensions or appearance resulting from the handcrafted nature of the products cannot give rise to liability on the part of Fleur du Népal.
• Retention of Title
The products remain the property of Fleur du Népal until full payment of their price, including charges and taxes.
Risk nevertheless passes to the customer when the customer, or a third party designated by the customer, takes physical possession of the products, in accordance with applicable legal provisions.
• Personal Data
The information collected when orders are placed is necessary for processing and shipping orders, order tracking and customer relations.
This data is processed in accordance with applicable regulations, including the General Data Protection Regulation (GDPR).
The customer has the right to access, rectify, erase and object to the processing of personal data, as well as the right to restrict processing and to data portability, under the conditions provided for by applicable regulations.

• Intellectual Property
All texts, photographs, illustrations, logos, graphics and content appearing on the website https://www.fleurdunepal.com remain the exclusive property of Fleur du Népal or their respective authors.
Any reproduction, representation, distribution, exploitation or use, whether in whole or in part, without prior written authorisation is strictly prohibited and may result in legal proceedings in accordance with the French Intellectual Property Code.
• Consumer Mediation
In accordance with Articles L.611-1 et seq. of the French Consumer Code, consumer customers have the right to use a consumer mediator free of charge with a view to the amicable settlement of a dispute with Fleur du Népal.
If the dispute cannot be resolved amicably with our customer service, the consumer may refer the matter free of charge to the following consumer mediator:

• Applicable Law
These General Terms and Conditions of Sale are governed by French law.
If any provision of these General Terms and Conditions of Sale is declared null, invalid or unenforceable by a final court decision, the remaining provisions shall remain fully applicable.
In the event of a dispute, the parties shall first seek an amicable solution.
Failing an amicable settlement, the dispute shall be submitted to the competent French courts, subject to any mandatory consumer protection provisions that may apply.
• Acceptance of the General Terms and Conditions of Sale
By confirming an order, the customer fully and unconditionally accepts these General Terms and Conditions of Sale.
The customer acknowledges having read these General Terms and Conditions of Sale before confirming the order and declares that they accept them in full.
