Terms and Conditions of Sale
These General Terms and Conditions of Sale govern all relations between the sole proprietorship Cédric Caprais – Fleur du Népal, publisher of the website https://www.fleurdunepal.com, with its registered office at 15 rue Robert Surcouf, 33510 Andernos-les-Bains, France, and its customers.
Before placing any order, the customer acknowledges having read these General Terms and Conditions of Sale and accepts them without reservation when confirming their order.
• Specific conditions of sale
The customer acknowledges having read, at the time of placing the order, the essential characteristics of the products offered, including their name, price, composition, dimensions, weight, colors, availability, delivery costs, and any limitations applicable to certain products.
The confirmation of the order implies full and complete acceptance of these General Terms and Conditions of Sale.
• Product sheets
The photographs illustrating the products are not contractual. Despite the care taken in their creation, slight color differences may appear depending on the screens used.
Product descriptions are prepared with the utmost care based on the information available to us.
• Order
Every order is subject to a summary listing all products selected by the customer before validation.
Payment for the order can be made using the payment methods offered on the store, including:

Fleur du Népal confirms the acceptance of the order by email.
The sale is deemed concluded upon dispatch of this confirmation.
Fleur du Népal reserves the right to refuse or cancel any order, particularly in case of supply problems, obvious error, suspicion of fraud, illegible document, dispute with the customer, or any other legitimate reason.
Any new order may be refused as long as the amounts due for previous orders have not been paid in full.
• Delivery
Orders are shipped by La Poste, Mondial Relay, or any other carrier chosen by Fleur du Népal.
Delivery is made to the address indicated by the customer when placing their order. This address must be complete and accurate.
The delivery times indicated on the site are given for information purposes only. They may vary depending on the destination, the carrier, customs formalities, or any event beyond our control.
Fleur du Népal cannot be held responsible for a delivery delay resulting from a case of force majeure or external circumstances such as strikes, natural disasters, fires, technical failures, disruptions of transport networks, or any other event preventing the proper execution of the order.
Products remain under the responsibility of Fleur du Népal until their actual delivery to the customer or a third party designated by the customer, in accordance with the provisions of the Consumer Code.
The customer is invited to check the condition of the package upon receipt and to report any anomaly to the carrier as well as to Fleur du Népal as soon as possible.
In case of stock shortage or temporary unavailability of a product, Fleur du Népal may offer the customer a refund, exchange, or deferred shipment after the customer's agreement.
An order comprising several items may be shipped in several packages without additional cost to the customer when necessary.
• Price
Prices displayed on the site are expressed in euros (€) and include all taxes (TTC), excluding participation in delivery costs.
Fleur du Népal reserves the right to modify its prices at any time. However, products are invoiced on the basis of the rates in force at the time of order validation by the customer.
Any delivery costs are indicated before the final validation of the order.
For deliveries outside the European Union, customs duties, local taxes, or import fees may be required by the authorities of the destination country. These costs remain exclusively the responsibility of the customer.
• Right of withdrawal
In accordance with the provisions of the Consumer Code, the consumer customer has a period of fourteen (14) days from the receipt of their order to exercise their right of withdrawal, without having to give reasons for their decision or incur costs other than those provided for by law.
Commercially, Fleur du Népal accepts returns up to thirty (30) days after receipt of the order, subject to compliance with the conditions below.
The right of withdrawal cannot be exercised for products excluded by current regulations, particularly when they have been customized at the customer's request.
• Returns
Returned items must be new, unworn, unwashed, odorless, undamaged, and returned in their original packaging or gift pouch, accompanied by any accessories or instructions.
Any product returned incomplete, used, damaged, soiled, or unfit for resale may be refused a refund or have its refund reduced in accordance with legal provisions.
Return costs remain the responsibility of the customer, except in case of preparation error on our part, defective product, or contrary legal provision.
Exchanges are possible depending on product availability.

The customer is invited to include their order number and their exchange or refund request to facilitate the processing of their case.
• Refunds
The refund is made by the same payment method as that used during the order, unless the customer expressly agrees to the use of another refund method.
The refund is made within a maximum of fourteen (14) days from the receipt of the returned products or proof of their shipment, in accordance with the provisions of the Consumer Code.
When the legal conditions are met, the refund includes the price of the returned products as well as the delivery costs corresponding to the standard delivery method offered at the time of the order.
No refund can be made before the receipt and verification of the returned products.
• Legal guarantees
All products sold by Fleur du Népal benefit from the legal guarantees provided for in articles L.217-3 et seq. of the Consumer Code as well as articles 1641 et seq. of the Civil Code relating to the guarantee against hidden defects.
The consumer benefits from a period of two years from the delivery of the goods to act under the legal guarantee of conformity.
Under the legal guarantee of conformity, the consumer can choose between repair or replacement of the goods, subject to the conditions provided for by law.
The consumer may also decide to implement the guarantee against hidden defects in accordance with the provisions of the Civil Code.
• Liability
Fleur du Népal cannot be held responsible for the non-performance or poor performance of the contract when this is attributable to the customer, a third party to the contract, or a case of force majeure within the meaning of French law and jurisprudence.
Fleur du Népal's liability cannot, in particular, be engaged in the event of interruption of internet networks, malfunction of payment services, delay attributable to the carrier or customs authorities, or any event beyond its control.
The photographs, illustrations, and descriptions of the products are presented with the utmost care. Slight differences in shade, dimensions, or appearance related to the artisanal nature of the products cannot engage Fleur du Népal's liability.
• Retention of title
Products remain the property of Fleur du Népal until full payment of their price, including costs and taxes.
However, risks are transferred to the customer at the moment the customer, or a third party designated by the customer, physically takes possession of the products, in accordance with legal provisions.
• Personal data
The information collected during orders is necessary for their processing, shipment, order tracking, and commercial relationship with customers.
This data is processed in accordance with applicable regulations, particularly the General Data Protection Regulation (GDPR).
The customer has a right of access, rectification, erasure, opposition, restriction of processing, and portability of their personal data, under the conditions provided for by current regulations.

• Intellectual property
All texts, photographs, illustrations, logos, graphics, and content present on the website https://www.fleurdunepal.com remain the exclusive property of Fleur du Népal or their respective authors.
Any reproduction, representation, distribution, exploitation, or use, in whole or in part, without prior written authorization is strictly prohibited and may result in legal action in accordance with the Intellectual Property Code.
• Consumer mediation
In accordance with the provisions of articles L.611-1 et seq. of the Consumer Code, the consumer customer has the right to use a consumer mediator free of charge for the amicable resolution of a dispute with Fleur du Népal.

• Applicable law
These General Terms and Conditions of Sale are governed by French law.
In the event that one of the clauses of these General Terms and Conditions of Sale is declared null or unenforceable by a final court decision, the other provisions shall remain fully applicable.
In case of dispute, the parties will primarily seek an amicable solution.
Failing an amicable agreement, the dispute will be submitted to the competent French courts, subject to the protective provisions applicable to consumers.
• Acceptance of the General Terms and Conditions of Sale
The customer's confirmation of their order implies full and complete acceptance of these General Terms and Conditions of Sale, without reservation.
The customer acknowledges having read these General Terms and Conditions of Sale before validating their order and declares to accept them in their entirety.
